Official platform terms governing access to The Dolphinne Technologies, including Dolphinne ATS (AI Recruitment & Proctoring) and Dolphinne Stores (AI Storefronts & Dynamic UPI Commerce).
Electronic Record Notice: This document is an electronic record generated by a computer system in terms of the Information Technology Act, 2000, and rules thereunder as applicable, including Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011. It does not require any physical or digital signatures.
Platform Ownership & Legal Entity
The domain names dolphinne.com, ats.dolphinne.com, and store.dolphinne.com (collectively the "Platform") are owned and operated by The Dolphinne Technologies / ABHIMANYU PANKAJKUMAR SONI, with its registered office at A/M/5, Raj Plaza Complex, Near Sonal Cross Roads, Gurukul Road, Memnagar, Ahmedabad - 380052, Gujarat, India (hereinafter referred to as "Platform Owner", "Company", "we", "us", or "our").
User Responsibilities & Acceptable Use
- Account Accuracy: Users must provide true, accurate, current, and complete credentials during registration. Impersonation of any individual or entity is strictly prohibited.
- Security of Credentials: Users are entirely responsible for safeguarding password and two-factor authentication credentials, and for all actions taken under their account.
- Prohibited Activities: Data scraping, reverse-engineering proprietary model weights, distributing malware, executing denial-of-service attacks, or bypassing security filters will lead to immediate account termination and legal prosecution.
- Lawful Usage: You agree never to use our Services for any unlawful purpose forbidden by Indian laws, IT Act 2000, or local regulations applicable to your jurisdiction.
AI Recruitment Suite & Proctoring Framework
3.1 7-Day Free Trial
A 7-day complimentary trial is available for enterprise HR teams and recruiters to test AI voice interviews without submitting credit or debit card details upfront. Users must activate a recharge pack before the trial expires to continue accessing scoring logs and proctoring reports.
3.2 Prepaid Recharge Packs (No Forced Auto-Renewals)
Dolphinne ATS operates on a transparent pay-as-you-go recharge model (Starter, Growth, Enterprise). There are no hidden subscriptions and no unauthorized auto-debits.
- Recharges are available for validity durations of 6 months, 12 months, or 18 months.
- Any unused candidate interview credits expire immediately upon the conclusion of the validity window.
- Purchased recharge packs are non-refundable once activated.
3.3 Candidate Consent & Biometric Telemetry
Recruiters and employers are legally required to notify interview candidates that Dolphinne ATS records voice responses, webcam video, and gaze orientation strictly to produce proctoring integrity scores. Explicit candidate consent is mandatory before initiating automated AI voice sessions.
Storefront Builder & 0% UPI Dynamic Settlement
4.1 0% Platform Transaction Commission
Dolphinne Stores enables merchants to generate dynamic NPCI UPI QR codes for direct peer-to-merchant settlements. Dolphinne charges 0% commission on merchant transactions. Funds settle straight from the customer’s bank account into the verified merchant account without intermediate holding escrows by Dolphinne.
4.2 Merchant Catalog & Product Compliance
Merchants bear 100% legal responsibility for products, prices, descriptions, shipping fulfillment, and quality standards published on their storefront. The listing of counterfeits, prohibited narcotics, pirated media, explosive materials, or deceptive merchandise is strictly forbidden and triggers immediate de-platforming.
4.3 Taxes & Statutory Compliance
Merchants are exclusively responsible for assessing, collecting, reporting, and remitting all applicable GST, customs duties, or local taxes arising from transactions concluded through their storefront microsites.
Intellectual Property & Indemnification
All software source code, proprietary AI scoring heuristics, 27+ cultural storefront layouts, graphic assets, typography, and trademarks associated with Dolphinne are the exclusive property of The Dolphinne Technologies. No license or title is transferred by mere usage.
Indemnity: You agree to indemnify, defend, and hold harmless The Dolphinne Technologies, its directors, officers, employees, and affiliates from any claim, liabilities, damages, penalties, or legal fees arising from your breach of these Terms, misuse of the Services, or infringement of third-party rights.
Disclaimers & Limitation of Liability
Our Services and SaaS tools are provided strictly on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. Under no circumstances shall The Dolphinne Technologies be liable for indirect, punitive, incidental, or consequential losses, including lost revenue, server downtime, candidate interview outcomes, or commercial merchant disputes.
Force Majeure: Neither party shall be held liable for failure to perform due to causes beyond reasonable control, including natural disasters, internet infrastructure outages, telecommunication failures, or governmental actions.
Governing Law & Dispute Resolution
These Terms and any dispute, claim, or controversy arising out of or relating to their subject matter shall be governed by and construed in accordance with the laws of the Republic of India.
